01. Purpose
HSO Petroleum Services LLC, (“HSO”) operates a marketplace specializing in industrial products, equipment, components, replacement parts, tools, safety products and energy infrastructure products. This Policy establishes categories of products whose listing, sale, distribution or fulfillment may be prohibited, restricted or subject to additional compliance, transportation, safety or documentation requirements.
The purpose of this Policy is to protect marketplace integrity, ensure legal compliance and reduce regulatory, operational, commercial and safety risks.
02. HSO’s Right to Restrict Products
HSO may, at its sole discretion and at any time:
- Reject a product listing;
- Remove existing listings;
- Suspend or cancel orders;
- Restrict certain jurisdictions or countries;
- Require additional documentation;
- Require regulatory certifications;
- Limit available shipping methods;
- Block accounts;
- Suspend partners or suppliers; and
- Take any action reasonably necessary to protect the marketplace or comply with legal obligations.
Approval of a listing does not guarantee permanent acceptance of a product.
03. Prohibited Products
Unless expressly authorized in writing by HSO and legally permitted, the following products may not be listed, offered or sold through the marketplace:
- Counterfeit products;
- Stolen or unlawfully sourced products;
- Products with altered, removed or manipulated serial numbers;
- Products that infringe intellectual property rights;
- Products supported by false or fraudulent documentation;
- Products accompanied by fraudulent certificates;
- Products falsely represented as OEM, Genuine, Original or Authorized;
- Recalled products whose commercialization is prohibited;
- Products prohibited from sale under applicable law;
- Products subject to applicable sanctions or embargoes;
- Products that violate export-control or import-control requirements; and
- Any product that HSO reasonably determines creates legal, operational, compliance or reputational risk.
04. Restricted or Controlled Products
The following categories may be subject to review, approval or additional requirements:
- Hazardous materials;
- Dangerous goods;
- Explosive materials;
- Flammable substances;
- Compressed gases;
- Regulated chemicals;
- Certain industrial batteries;
- Regulated pressure equipment;
- Valves and components subject to mandatory certifications;
- Regulated electrical equipment;
- Export-controlled products;
- Dual-use items;
- Products requiring governmental licenses;
- Products intended for sensitive or regulated industries; and
- Products restricted by carriers, customs authorities or regulators.
HSO may approve, reject or condition acceptance of such products based on documentation and compliance review.
05. Shipping and Transportation Restrictions
Not all products are suitable for conventional parcel transportation.
Where applicable, partners and suppliers must:
- properly classify products;
- provide Safety Data Sheets (SDS) when required;
- comply with packaging requirements;
- comply with labeling requirements;
- provide required regulatory documentation; and
- comply with carrier requirements.
Where permitted by applicable law and carrier requirements, orders may be fulfilled and shipped through DHL, FedEx or another qualified carrier selected by HSO or the applicable fulfillment partner.
HSO may refuse fulfillment or shipment of products that do not meet applicable transportation, safety or regulatory requirements.
06. Partner and Supplier Obligations
Each partner and supplier represents and warrants that:
- it has title to or authorization to sell the products;
- products are authentic;
- product information is accurate;
- availability information is reasonably accurate;
- required certifications are valid;
- applicable laws are observed;
- export-control and import requirements are satisfied;
- environmental and safety requirements are satisfied; and
- it will promptly notify HSO of any recall, safety notice or regulatory action relating to a product.
07. Violations
HSO may suspend listings, cancel orders, withhold payments, suspend accounts or terminate business relationships where a product violates this Policy or creates safety, regulatory, compliance or reputational concerns.
